New York Times Article: Pete Thamel uncovers UCF, Brandon Bender and an ex-con
Looks like our suspicions were right all along! Check out page three. Seems like Bender and UCF have some explaining to do. Hopefully D. Smith will get his release and be able to become a Card. I have an inside source that says Bender is telling people in Louisville that he is the new Director of Basketball Operations at UCF. What a piece of trash.

If I'm completely honest, this is quite damning indeed.
Directly implicates both Bender and Caldwell as being illegal runners for UCF and arranging what amount to major violations in the recruitment of Kevin Ware. There are also serious implications about the recruitment of D Smith and Chandler, with supporting testimony from coaches and family members.
This could end up being a major blow to UCF (and a major boon to UL). UCF’s football program is already on probation for “major” violations, and if more are uncovered, they could receive the first death penalty since SMU. No wonder USF was fighting the Big East adding them; this is their backyard, and they probably knew what was going on.
An interestingpoint was brought up on the Afternoon Underdogs.
Everyone knows that UCF is this (-) close to being a BCS team and jumping Nova. It was brought up the huge difference in revenue. So while they are at it, even if they pay a few players, nothing will surface for years, right? They won’t be able to just kick them out of the conference.
Point is, UCF is going to do everything they can to get the best players possible, because they are so close.

Well O'Leary did say that one of the reasons he wouldn't release him
was that he spent a lot of time and MONEY recruiting the kid. Now it seems he may have been telling the truth. If he was paying Bender to recruit Smith then I can see why he’d want a return on his investment. Very business-like move there.

on a side note. Something really needs to change regarding college recruiting. Things are getting way out of hand and at a point where I feel something needs to change. I could not imagine being 18 and having to deal with the crazy recruiting tactics etc that are currently being utilized. With the shady coaches, 1000 dollar hand shakes, runners, nba guys, aau guys, its just crazy. Im almost to the point where I feel they need to do away with recruiting all together..

As much as I love college football and basketball what it has become is sickening
They might as well stop labeling these kids as student athletes and start paying them some type of compensation. This is no different then whats going on at UK, Baylor and some of these other dirty schools who deal with agents and runners. We could have landed Quincy Miller and Duece Bello Rick just refused to deal with runners and the rest of the BS that came with them. And as for Bender….he needs to be banned from stepping foot in Jefferson County

Brandon Bender?
Sorry for my ignorance, but I have heard Brandon Benders name come up several times lately. Supposedly he had a bad experience here and was released to transfer. Is there more to the story? What happened to make him so anti-Louisville?
In short, he's a wanna-be runner for college coaches & part time AAU coach
Long version:
Played ball at Ballard HS in late 90s, had a cousin (Jonathan Bender) who skipped college to go to the NBA, thought he was better than said cousin, claimed he would forgo his senior year (2000-2001) at Ballard to declare for the NBA draft, that didn’t work out, committed to Louisville but was essentially kicked off the team his freshman year for violating team rules.
In the 10 years since that time, he played semi-pro ball overseas for a few years and more recently has coached an AAU team. Has high aspirations to be a legit college staffer and is always bragging to whomever will listen about texting D1 coaches and recruits. Used his personal facebook account at one time to “guarantee” that certain Louisville commits would never actually sign with U of L and constantly touted all the coaches & players he talks to.
It’s widely speculated that Bender advised several high school basketball recruits not to sign with Louisville b/c of his grudge with Pitino and personal issues with the University. When Bender was spotted at DaMarcus Smith’s “business decision” press conference, many assumed something shady happened with Bender & UCF.

As a parent, what’s really sad is that there’s 20 Brandon Bender types in this town. They target MIDDLE SCHOOL kids. Any parent that has a kid that plays Football, Baseball or Basketball will know who those guys are.

Bender is such a POS and now the whole country knows it. He better watch out in Louisville from now on (apparently he hangs up at Ballard all the time). As for Smith, I say he gets what he deserves. If you are stupid enough to listen to a fool like Bender and sign with a crappy school like UFC you deserve everything thats coming to you (sitting out a year and having to play ball at a lower-tier university). I was initially upset when Smith committed to UCF but now its clear what he meant by ‘business decision’. I say good riddance, UL football will be great without Smith and HCCS is not going to touch the kid now that this has all come out.

The article specifically says that D Smith was bullied into signing with UCF by Bender and, more importantly, his mother. He wanted to sign with UL all along.
The article says he was coerced by his mother, not Bender.

Being pressured or even forced to sign a LOI, even if O’Leary refuses the release the contract should be voidable due to duress and/or undue influence. Both are common contract law knowledge. Surely he has someone on this?

But a contract is a contract, and a promise enforceable by law, any public or private contract between any two parties is subject to judicial review. In this case I don’t think the NCAA gets much of a say so if he wanted to take it to court

I haven't done any research
But my instinct says no. As expensive as litigation would be for the student-athlete, I would say if this situation has ever happened before they likely didn’t pursue the release through court.
From this side of the fence it looks pretty clear cut though, I don’t see how anyone could rule it enforceable if they decided to take it there.

I think only one does.
Either way, if anything is done to UCF, the students will likely be allowed to transfer without penalty. That’s generally what happens in these situations (i.e. SMU, USC).

I am in awe of how UCF fans are responding to this story.
Short List of things I’ve seen from the Orlando Sentinel and UCF boards/blogs:
- Everyone does it, so why can’t we?
- Forde wrote a book with Pitino, so he committed NCAA violations by talking to recruits. He’s a booster.
- Whoever Purvis commits to better watch out. Pitino will have Thamel/Forde go after them next.
- It’s proof that the “big boys” don’t want competition.
Really, UCF? That’s how you want to handle this? Relational self-justification, blame shifting and conspiracy theories? Sound like UK fans in all this mess. Accept the fact that your program is already on probation and accept that stories like this do not bode well that things are not on the “up-and-up” surrounding the program. You should be hoping for a through investigation to determine wrong-doing, report any wrong-doing, take preemptive corrective action and hope for the best from the NCAA.

Craziness
No proof has come out yet that UCF did anything wrong, yet the extreme p.o.v. of many aligns with catchy media. RemoteCardinal, I read just about every thing written/committed on about UCF, and if thats what you took, you must be an incredible Cards fans. You’re looking through some distorted, albeit passionate, lens. Not even close to what has been said.
The question remains, why UCF? The only player that shocked me thus far was Smith. We have Godfrey (who’s young) so Smith would ride the bench. There is too much that goes into recruiting for these generalizations. Also these violations lack any substantiation. If the NCAA finds anything (which thus far they seem to be struggling) I’ll be the first to admit UCF f’ed up.
