Brent Guy, Joe Kenn sue U of L for breach-of-contract
Sounds like U of L is just gonna have to pony up here.
Unlike the rest of Steve Kragthorpe's assistant coaches, who signed one-year deals, Guy and Kenn had signed two-year contracts that ran through June 30, 2011.
According to the suit filed in Jefferson Circuit Court, the ULAA informed Kenn and Guy on Dec. 15 that they would receive only partial compensation that would terminate on June 15.
Guy, the defensive coordinator last season, and Kenn, the strength and conditioning coach, had provisions in their contracts stating that the "ULAA may terminate this position in the event that the head coach in football vacates his position at the university."
The suit says their contracts "do not permit ULAA to terminate the employment contracts in the event that the head coach in football is terminated."
Neither side would comment on the suit.

Can’t blame these guys for asking for what’s contractually theirs. We’d all do the same thing.

Their employment
should have been conditional on Krag’s employment (not just him leaving, but also him being fired). Hope the lawyers have learned their lessons.

Termination for Cause Clause in the Contract? We might have trouble proving they intentionally destroyed the program…

I believe in this state, you can be fired for having one shoe untied or one button unbuttoned.
my feeling is that while they may be correct that they should be paid according to the contract, the spirit of the deal is solely based on (name redacted)’s continued employment here. I think that if the university wants to hold to the letter of the contract, make them highly paid ticket takers at all of the sports events.

Settle with them quickly and move on.
They don’t want to pay their lawyers any more than we do, so they will be willing to settle. Write the checks due and move on to blanketing the city with Charlie Strong support.

I wonder if UofL is planning on fighting this
It seems like they would have tried to settle before filing the case, and if they had tried to settle and the university knew they would have to pay them anyway, they would have settled and not let them file the case. From what I know, the school’s only grounds for not paying them would be to say that the clause saying they would be terminated if Krag left is essentially the same as them being terminated if Krag got fired. I don’t know if that would hold water or not. Depends on precedent. This is all speculation though. I guess we will see what happens.
