Enes Kanter ruled ineligible to play at Kentucky

Here's the release from the NCAA:

The NCAA student-athlete reinstatement staff has ruled University of Kentucky men’s basketball student-athlete Enes Kanter permanently ineligible for receiving benefits above his actual and necessary expenses while playing for a club basketball team in Turkey.

The university will appeal the decision to the Division I Student-Athlete Reinstatement Committee at the end of the month.  The reinstatement committee is the final appeal opportunity in the initial-eligibility process.  It is independent and comprised of representatives from NCAA member colleges, universities and athletic conferences and can reduce or remove the conditions, but it cannot increase the conditions imposed by the staff.

Actual and necessary expenses are defined by NCAA rules and generally relate to a player’s expenses directly necessary for practice and competition on a team.  Some examples include meals and lodging directly tied to practice or competition, coaching, medical insurance and transportation tied to practice or competition.

Kanter played three seasons with the Turkish sport club Fenerbahce from 2006-07 to 2008-09. Although he competed primarily for the club’s under-18 junior team, he did compete on the club’s senior team in 2008-09. According to facts agreed to by the university and the NCAA Eligibility Center, Kanter received $33,033 more than his expenses for the 2008-09 season.  

The new NCAA rule that allows prospective student-athletes to compete on teams with professionals while maintaining their amateur status prior to college applies; however, the bylaw states any such benefits cannot exceed actual and necessary expenses, which was the case here.  

 "Enes took advantage of an opportunity to play at the highest level available to him, but the consequences of receiving payments above his actual expenses is not compatible with the collegiate model of sports that our members have developed," said Kevin Lennon, NCAA vice president of academic and membership affairs.

The reinstatement staff considers a number of factors when deciding each case. These include the nature and seriousness of the violation; any impermissible benefits received; the student-athlete’s level of responsibility; any mitigating factors presented by the university; applicable NCAA guidelines; and any relevant case precedent.

"We appreciate that the NCAA has an appeals process to allow this young man to defend the uniqueness of his circumstances," said Mitch Barnhart, University of Kentucky director of athletics. "Enes is a great kid who is working hard in the classroom and enjoying being a college student.  It is our hope that he will be allowed to continue his academic and athletic career at Kentucky."

Kanter moved to the United States in 2009 and attended a prep high school before enrolling at Kentucky this fall.
NCAA student-athlete reinstatement guidelines allow Kanter to resume practicing but not compete or travel with the team while the appeal is pending.

SUMMARY OF TIMELINE

The NCAA Eligibility Center staff first contacted Kentucky in March 2010 and Enes Kanter directly on March 24, 2010, with questions about his involvement with a Turkish professional basketball team.  From the beginning and throughout the process, the university and the NCAA conducted multiple interviews and compiled documentation pertinent to the case.  

In June, the NCAA staff provided Kentucky and Kanter with information it received indicating Kanter received benefits from the Turkish team.  In August, Kanter and his father acknowledged receiving those benefits.  From August to mid-October, NCAA staff assisted Kentucky as it pursued its due process with factual and interpretive appeals.

On Oct. 25, Kentucky agreed to the statement of facts in the case and on Oct. 27 asked the student-athlete reinstatement staff to rule on his eligibility. The staff, after an initial review, asked for more information on Nov. 1.  Kentucky responded on Nov. 4 and 8, and the NCAA reinstatement staff made its decision on Nov. 11.

you think Alabama isnt all over Cam Newton right now? UK’s best sports blog covered and ripped Pitino at his trail more than any news source in the city of Louisville. Its a HUGE rivalry and its hotter than i’ve ever seen it. When Dieng was ineligible, when we lost Coleman, when we lost Bello and Miller, when we lost Sallie…its on the UK blogs and message boards. Thats the way it is. If they don’t talk about you..then you arent doing something right. UK has had a lot of good news, we’ve sat back and took it as we’ve been through the ringer. Why would Mike sit back and not report this? He could say negative things about line beards, and abortions to get his point across. But instead he kept it classy Louisville

Who cares what goes on UK boards.

I actually will root for the Cats when they play anyone other than UL (my team forever) or KU (my alma mater, the place where I commissioned through, and the place where I got my MBA – mainly due to location of my children…).
I don’t go to UK blogs for any reason unless there’s a link that has directed me there for some reason or something. Hell, even coming on here occupies too much of my time and I’m less efficient at work than I need to be…

i respect that

but its hard for a lot of Louisville fans to root for UK when they take verbal beatings all the time. my wife and a lot of my friends are UK fans so i can respect the Cats because my freinds dont ride me up and down everytime something happens in Louisville. Thats not what happens for all UL fans. And I care about UK boards. You may not go there but i do and i bet many others go there too. Its a rivalry, i want to know whats going on and i want to beat them.

and my whole father’s side of the family is full of Cat fans. I don’t get too much though as I live in Kansas…or wherever the Army sends me essentially. I give most UK fans that I run into a little guff, but all in good fun and respectfully. The only place I’ve run into completely idiotic UK fans has been on the cbssports UofL boards… But half of those are mainly fools who shouldnt have any access to any kind of computer and it’s obvious that they didn’t graduate from any reputable highschool for the most part…

Which is 90% of the problem most of the time. Instead of taking the verbal beatings, don’t. Own those f*ckheads (the disrespectful douche bags) at every turn, every uttered word of stupidity, every syllable. You will be the last person they attempt to blast with the uk fan handbook, always.

Seriously, half the reason Louisville fans complain about uk fans being nasty to them is because they allow it. They tolerate it. They refuse to sink to their level. Shit, fuck that. Let some inbred sack of shit key my car over a football game (or otherwise) and I’ll show you a redneck barbecue with their rusty pickup skewered on a spit.

Don’t turn a blind eye and let it be because it’s only a game. If a uk fan attempts to disrespect me, I look at them no different than some random punk on the streets. They start a battle, give’em war. Next thing you know they’ll suggest going out to watch a game together and drink a few beers. Problem solved.

Sorry, but that game always transcends either team’s need for a W. And it’s not like UK will trying to scrape together just enough victories to get into the NCAAs (not with the annual influx of “so-so” recruits). So even though I don’t think you were trying to say, “This is me not caring about Louisville,” well… let’s not go there.

No, actually my point is that where we might have been able to afford ourselves a loss or two outside the SEC this year

Now we will not. We will have to scrape for every win that we can get early on. Getting through the SEC unscathed is virtually impossible. So if we can hold down the OOC losses to one, maybe two, then we stand a chance of holding serve come tournament time. Did not mean to downplay the significance of the game in any manner. I honestly believe that this is going to hurt us a lot more defensively than offensively. We have shooters, we need rebounders. Then again, we may have to play 35 shootouts this year, I don’t know. Will have to see how it all plays out.

Vargas will be fine. And we have alternatives for the position, they are just not earth shattering now.

Miller played the 5 some when we were in Canada because none of the big guys made the trip. Jones has stepped up and so has Harrellson. Let’s just see what occurs before we claim victory by anal rendering, shall we?

I mean, he just needed a break. I guess you guys never needed a break in your life. And, him getting paid $100K is no different than kids in the US sleeping in dorm rooms and eating cafeteria food for free.

Plus, the guy who said this doesn’t even speak english, Thamel misquoted his dad when he said he was a good student, and the world hates UK, UMASS, Memphis, and wherever Cal ends up next.

Seriously though- is this the first player Cal has ever not been able to get eligible? He’s slipping. He’s lost it. Fiar Cal!
